In South Carolina, court are required to determine the “best interest of the child” in a custody case. Some of the factors considered in determining what is in the child’s best interest include but are not limited to:

  • The temperament and developmental needs of the child;
  • The ability of the parents to meet these needs;
  • The child’s preference;
  • The parents’ wishes;
  • The past and current interaction and relationship between the child and parent(s), any siblings, and/or any other important individuals in their life (such as grandparents);
  • Any actions of each parent to encourage a continuing relationship between the child and the other parent;
  • Any manipulation or coercive behavior by either of the parents concerning any parental disputes, including any efforts to disparage the other parent in front of the child;
  • The ability of each parent to be actively involved in their child’s life;
  • The child’s adjustment to their surroundings (school, community, activities, etc.);
  • The relative stability of any relevant residences;
  • The mental and physical health of all individuals involved;
  • Cultural and spiritual backgrounds;
  • Whether there has been any domestic violence or child abuse between any family members;
  • Any relocation that as taken place in the past year; and
  • Any other factors the court deems necessary.
